1. Acceptance of Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you and DailyYardSales.com (“we,” “us,” or “our”) governing your access to and use of the DailyYardSales.com website, mobile applications, and related services (collectively, the “Service”).
By creating an account, posting a listing, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
2. Eligibility
To use DailyYardSales.com, you must:
- Be at least 18 years of age (or 13 with verified parental consent for browsing only)
- Be a resident of the United States or its territories
- Have the legal capacity to enter into a binding contract
- Not have been previously suspended or banned from the Service
- Provide accurate, current, and complete registration information
Sellers must additionally have the legal right to sell the items listed. You may not use the Service on behalf of any person or entity without their express written authorization.
3. User Accounts
When you create an account, you are responsible for maintaining the security of your credentials and for all activity that occurs under your account. You must:
- Choose a strong, unique password and keep it confidential
- Notify us immediately at hello@dailyyardsales.com if you suspect unauthorized access
- Ensure your account information remains accurate and up to date
- Not share your account with others or create accounts for third parties without authorization
- Not create multiple accounts to circumvent bans or listing limits
We reserve the right to disable or terminate accounts that violate these Terms, show signs of fraudulent activity, or have been inactive for more than 24 consecutive months.
4. Listing Rules
DailyYardSales.com is a classifieds platform for Phoenix and the Valley, Arizona. It carries four kinds of listing: sales (yard, garage, estate, moving, tag and rummage), vehicles offered by private sellers and dealers, property for rent, and job vacancies. All listings must comply with the following rules:
5. Prohibited Content
The following content is strictly prohibited on DailyYardSales.com. Violations may result in immediate account termination and reporting to law enforcement:
- ✗Weapons, firearms, ammunition, or explosive devices (regardless of legality)
- ✗Controlled substances, prescription drugs, or drug paraphernalia
- ✗Stolen property or items without proof of ownership
- ✗Counterfeit, fake, or replica items misrepresented as genuine
- ✗Live animals (adoption listings should use appropriate platforms)
- ✗Adult content, pornography, or sexually explicit material
- ✗Content that targets, harasses, or discriminates against individuals or groups
- ✗Pyramid schemes, multi-level marketing, or fraudulent investment offers
- ✗Personal information of others without their consent
- ✗Malware, spam links, or phishing content
- ✗Items that violate intellectual property rights (bootlegs, pirated media)
- ✗Human tissue, body parts, or regulated medical devices
6. Free Listings
Posting and reading listings is free. We do not currently sell any listing upgrades. If we introduce a paid option, these Terms will be updated before any charge is offered.
7. Payments & Refunds
We take no payments through the site. Advertising and website-design services are agreed and invoiced directly with the business concerned, under the terms stated on that invoice. Questions about an invoice go to ads@dailyyardsales.com.
8. Intellectual Property
Our content: DailyYardSales.com, its logo, design, software, AI features, and original content are owned by or licensed to us and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
Your content: You retain ownership of all content you post (listings, photos, descriptions). By posting content, you grant DailyYardSales.com a worldwide, non-exclusive, royalty-free license to display, reproduce, and distribute that content on the platform and in promotional materials. This license ends when you delete your content.
DMCA: If you believe content on our platform infringes your copyright, please send a DMCA takedown notice to legal@dailyyardsales.com with: (1) identification of the copyrighted work, (2) identification of the infringing material, (3) your contact information, and (4) a statement of good faith belief.
9. Disclaimers
Platform Only: DailyYardSales.com is a classifieds platform. We do not participate in, facilitate, or guarantee any transactions between buyers and sellers. All purchases and sales are made directly between private parties.
No Warranty: The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, or non-infringement.
Listing Accuracy: We do not verify the accuracy of listing content. Buyers should independently verify all information before attending a sale or purchasing any item.
Safety: Meeting strangers involves inherent risks. We encourage users to follow basic safety precautions: bring a companion, meet in public areas when possible, trust your instincts. We are not responsible for incidents at listed sale locations.
10. Limitation of Liability
To the maximum extent permitted by applicable law, DailyYardSales.com and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, data, or goodwill; personal injury; or property damage arising from your use of the Service.
Our total liability to you for any claims arising from use of the Service shall not exceed the greater of (a) $100 or (b) the total amount you paid to DailyYardSales.com in the 12 months preceding the claim.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above may not apply to you in full.
11. Indemnification
You agree to indemnify, defend, and hold harmless DailyYardSales.com and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:
- Your use of or access to the Service
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property rights
- Any content you post, list, or transmit through the Service
- Any transaction or interaction with other users
12. Termination
By you: You may delete your account at any time from your profile settings. Upon deletion, your listings are removed within 24 hours and your data is handled per our data retention policy.
By us: We may suspend or terminate your account immediately, without notice, if we determine you have violated these Terms, engaged in fraudulent activity, or if required by law. We will provide notice where reasonably practicable.
Upon termination, your right to use the Service ceases immediately. Sections 8 (IP), 9, 10, 11, and 13 survive termination.
13. Disputes
Talk to us first: if something goes wrong, contact us at legal@dailyyardsales.com and we will try to resolve it within 30 days.
Your rights: nothing in these Terms takes away any right you have under the consumer-protection or other laws that apply to you.
Disputes between users — a buyer and a seller, a landlord and a tenant, an employer and an applicant — are between those users. We are a listings service, not a party to any sale, tenancy or employment.
14. Changes to Terms
We may modify these Terms at any time. When we do, we will update the “Last updated” date above and notify registered users by email at least 14 days before changes take effect for material changes. For minor changes, the updated date is sufficient notice.
Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and may delete your account.
